In the situation with the Akademik Ioffe ship, it is urgent to work with lawyers and challenge the court’s decision, lawyer Vasily Davydov believes. He expressed this opinion on Friday, November 5, in an interview with Izvestia.
According to him, it is necessary to familiarize yourself with the charter agreement in detail, because the obligations of each of the parties are probably spelled out there.
“These injuries, they appeared there for a reason. Someone inflicted them. Appropriate protocols were to be drawn up. It is possible that in this case the losses and damages must be paid by the insurance company. Therefore, it is difficult to speculate on this topic without knowing how the burden of responsibility is distributed between the parties, ”he stressed.
The lawyer noted that the travel company Ocean Expedition paid funds or an advance to the owner of the vessel – the Institute of Russian Oceanology. As Davydov explained, as a result of bankruptcy, the party that ordered the services requires the return of the advance. Therefore, the court seized the property of the institute, that is, “Akademik Ioffe”.
According to the lawyer, in this case, the Institute of Oceanology needs to hire specialists in the law of the sea. However, the interlocutor of the channel noted, the time may have already been lost, since most likely there was some kind of lawsuit and interim measures are being taken within its framework.
“Perhaps they did not pay attention to this, now we urgently need to work with lawyers and challenge the court’s decision. I do not see any other development of events. I think this can be completely disputed. Now it is necessary to solve it precisely through judicial mechanisms, through the involvement of experts, ”concluded Davydov.
It became known about the detention of the vessel on November 4. There are 38 crew members and 23 scientific workers on board. The Russian Embassy has established contact with the Russians.
On the same day, Igor Kovalchuk, First Deputy Chairman of the Russian Trade Union of Seafarers, called on the Danish authorities to release the ship as soon as possible.
The details of the detention of “Akademik Ioffe” also became known. The incident took place on November 1 in the Danish port of Skagen based on a lawsuit filed by the Canadian company One Ocean Expeditions Ltd. The events that formed the basis of the lawsuit took place in 2019.
“Akademik Ioffe” is a 117-meter research vessel built in 1988 and named after the Soviet physicist Abram Fedorovich Ioffe. It has the status of a unique scientific installation and is used for experiments on long-range sound propagation in the ocean.
