If they refuse vaccination against COVID-19, Russians run the risk of receiving an administrative fine, but they are unlikely to face criminal punishment. Asad Yusufov, a lawyer and director of the Yusufov Group law firm, said this in a conversation with Lenta.ru.
“I don’t think there will be a criminal penalty for this – it’s just senseless, it’s not such a significant violation,” he said.
According to the lawyer, in this case, it is possible to apply clause 1 of Article 20.6.1 of the Administrative Code (“Failure to comply with the rules of conduct in an emergency or the threat of its occurrence”), according to which citizens can be fined from 1,000 to 30,000 rubles. He suggested that the average amount of the fine would be 5 thousand rubles.
Yusufov added that criminal punishment could already be threatened for falsifying a QR code, other official documents on vaccination or using someone else’s code. Earlier, he explained that in Russia there is a criminal liability for forging any official document that grants any rights or relieves of obligations (Article 327 of the Criminal Code). For the sale of non-existent QR codes, you can get a punishment under the article on fraud (159 of the Criminal Code).
On November 11, RBC, citing a source, said that the Russian government had developed two bills defining the procedure for introducing QR codes in public places and transport. It is assumed that will be introduced confirmation of immunization of citizens when visiting cafes and restaurants, as well as trains and planes. Until February 1, 2022, instead of the code, it will be possible to present a PCR test with a negative result, but after this date it will be valid only with a certificate of medical evacuation.
The operational headquarters confirmed the development of the relevant bills and specified that they would be additionally reported to the State Duma.
