Accepts the appeal of the former spokesperson for Sumar and the Prosecutor’s Office and lifts the suspension of the procedure
The head of the Court of Instruction number 47 of Madrid, Adolfo Carretero, has summoned Sumar’s former spokesperson Íñigo Errejón and his complainant, Elisa Mouliaá, to testify on January 16, after lifting the suspension of the case that he had issued in response to a reform appeal presented by the Prosecutor’s Office and the one promoted by the representation of the politician himself.
According to legal sources, the instructor has decided to continue processing the open case after Mouliaá denounced Errejón for crimes of sexual assault. However, he does not consider her a person in the case, which de facto implies that he will have to find a lawyer.
Judge Carretero agreed to a provisional dismissal of the matter when, after summoning Mouliaá to ratify the complaint and Errejón to question him, her lawyer requested a suspension, alleging that her advanced stage of pregnancy prevented her from participating in the proceedings.
After postponing the summons for a few days and given the persistence of the allegation that he was already on medical leave, the instructor opted for that route that left the investigation on hold without having finished starting. Errejón’s defense appealed directly due to the defenselessness created by having also been denounced in a public and notorious manner and not being able to defend himself.
