Supreme Court Judge Leopoldo Puente has rejected the request of the businessman Victor de Aldama to incorporate into the cause images of the visit of the Venezuelan vice president Delcy Rodríguez in 2020, to confirm that he was in Barajas with former minister Jose Luis Ábalos.
Aldama’s defense asked the judge that, “given the risk of destruction of the videographic evidence,” a copy of the recordings be required from the Court of Instruction number 31 of Madrid to prove the truth of your statement in court that was “questioned by Ábalos.” That case is filed.
The businessman recalled that after Ábalos’ statement on December 18, the former minister presented a document titled Contradictions to Víctor de Aldama’s statement in which, among other things, he says that “he lacked the truth” when addressing the story of the trip to Spainto the vice president of Venezuela Delcy Rodríguez, to the point of denying that the businessman was in Barajas that night. But the judge highlights, in line with the Prosecutor’s Office, thatThis diligence is not part of the purpose of the case since “the result of that would in no way justify the existence or non-existence of the facts that are the object of investigation here.”
“In other words: if the presence at the airport on January 20, 2020 of Aldama, accompanying Ábalos, was proven through the interested recordings, this would add nothing to the plausibility of the criminal acts that he attributes to him, nor, if the presence of Aldama on the aforementioned day at the airport facilities could not be proven, those accusations would therefore be denied,” says the judge.
He also explains that “it is not only that the events whose recording is requested go beyond the object of this special case, but also that It is not noted at this time that they could present a criminal nature.no matter how controversial the visit could be in political terms. For this reason, Puente makes it clear that “criminal proceedings are obviously not, and should not be, the appropriate setting for airing controversies of that nature.”
