The Judge of the Dana has cited the president of the Júcar Hydrographic Confederation as a witness, Miguel Polo, thus rejecting it in the case, as requested by the defense of the former regional former secretary Emilio Argüeso, investigated in the procedure together with the former Conssellera Salomé Pradas. The instructor rules out that there are indications of crime that justify the imputation of Miguel Polo, questioning the argüeso defense strategy, according to which there was an alleged informative blackout by the CHJ in relation to the increase in the flow of the Poyo ravine.
“You cannot claim an ignorance of those responsible for the Generalitat Valenciana del Saih [Sistema Automático de Información Hidrológica de la CHJ]nor of the possibility of access to it, nor in parallel to attribute criminal responsibility to the president of the Hydrographic Confederation, nor to practically all the positions, managers or not of said body, ”says a order issued this Thursday.
The instructor considers that “it is not admissible in any way” that Emilio Argüeso “unknown” the SAIH “nor the form of access to the data.” “In the event that it was so,” warns the car, “such ignorance would be part of the negligence that must be attributed to the management of an emergency.”
He also recalls that, according to the expert report contributed by the Defense of Argüeso on his communications on October 29, the then high emergency position said at 14.44, in reference to the Carlet area: “The ravines are about to collapse.” “What is a clear knowledge that overflows could occur, not only for the Carlet area, but with respect to the Poyo ravine,” the car adds.
The magistrate also rejects the imputation of the head of the Provincial Firefighters Consortium, José Miguel Basset; of the Immaculate official Piles, and the head of Communication of 112, Aurora Roca. The witness Alvise, “without any interest”

He also states that the allegations of the former Mazón position investigated in the case of calls at 112 are “contradictory” with the contribution of the communications and messages he declared to have received on his personal phone on the day of the DANA and whose transcription contributed his defense in an expert report shortly before the declaration of last April 11.
New complaint against the Aphorado Mazón
On the other hand, the instructor has inadmitted a new complaint of an individual, on April 16, against the president of the Generalitat, Carlos Mazón, for her condition as aggressor. “This without prejudice to the provisions of previous resolutions of this Court in which the appropriate offer to his declaration was investigated,” says the order.
The magistrate recalls that, given the status of the Chief of the Consell, her statement as investigated or complained “can only be carried out voluntarily whether for the Afore it will be requested.” An option that Mazón has declined to assume.
Thus, the resolution inadmits the last complaint against the regional president, “without prejudice to his voluntary declaration as investigated,” according to the judge in the operative part of the car.
In addition, the magistrate has accepted the personation of two new popular accusations, exercised by Compromís and by Intersindical Valenciana.
