The head of the Court of Instruction number 1 of Carmona has resolved to impute the leader of the PP of Seville, Ricardo Sánchez, and a member of the regional executive of Juan Manuel Moreno, Francisco Rodríguez Roa, among other party leaders, for his alleged participation in The urban plot of the Mairena del Alcor funeral home, where the Civil Guard has detected indications of influence peddling crimes, unfair administration and prevarication.
In a car broadcast this Wednesday, February 5, to which this newspaper has had access, the judge cites the investigation next March. This within the framework of the open cause against several leaders of the PP to paralyze for eight years the project of a public funeral home in Mairena del Alcor and authorize – in five months – another private to the family promoter of one of the investigated positions, Rodríguez Roa , in which he worked for eight years.
The judge also attributes the status of investigated for possible crimes of prevarication and trafficking of influence to the current mayor of the Sevillian municipality, Juan Manuel López, and José Navarro, former urban planning and current president of the PP of Mairena del Alcor. In total, six people appear on the list as investigated: the four popular leaders mentioned, as well as the legal advisor authorizing the granting of the private funeral home and the GESIT SL administrator, the mercantile requesting the work license on commission of the promoter Rodríguez Roa’s family (Previpaz SL).
Specifically, the magistrate attributes Ricardo Sánchez – also delegate of the Junta de Andalucía in the province and former mayor of Mairena del Alcor – an alleged crime of unfair administration; Juan Manuel López and Francisco Rodríguez Roa, a possible crime of influence peddling and administrative prevarication, in which the legal advisor is involved as a “necessary cooperator”. Roa is also charged with urban prevarication, together with the administrator of Gesit SL and José Navarro. These last two could also incur influence traffic.
Sanchez denies the accusations and the PSOE demands its cessation
After knowing his imputation in the case, the president of the PP in Seville has stated that he faces this situation “from the tranquility of having acted according to the law.” Ricardo Sánchez has assured that he is made available to justice in order to “clarify, collaborate and explain to the judge the facts to demonstrate the falsehood of the false accusations of the PSOE”, as expressed in a statement.
On the other hand, the judge’s order has led the PSOE Secretary of the PSOE of Seville, Rafael Recio, to demand the Andalusian president to “cease immediately” to the delegate of the Board in Seville, given his alleged involvement in the “scandal” of the Private Tanatorio of Mairena del Alcor that splashes him for his stage as mayor of the municipality. “Ricardo Sánchez cannot continue at the head of the Board delegation in Seville or one more day. Indications of possible crimes committed
The judge has decided to open the investigation around the plot of the Mairena del Alcor funeral home – denounced in April 2024 by the local PSOE – after studying the report of the Judicial Police of the Civil Guard, where the criminal indications are detailed fruit of “several months of hard work analyzing and studying a profuse documentary”, as highlighted by the car.
First, the judicial resolution refers to the “abandonment” of the public funeral home “in which € 21,118.76 in 2015” had been invested, under the mayor of Ricardo Sánchez. Hence, an alleged crime of unfair administration is imputed (punished with a prison sentence of two to six years, according to the Criminal Code) for having caused “a damage to the public assets managed by its position”, according to the police Judicial.
Next, the car focuses on the “irregularities” surrounding the construction of the private funeral home linked to the family business of Rodríguez Roa, which was authorized in “very short space of time”, while the municipal project remained stagnant for years. At this point, the judge refers to the conclusions of the Judicial Police to justify the possible imputation of a crime of influence peddling (with prison sentences from six months to two years) when the “prevalence of public office and their Relationship with each other, in favor of an economic interest in between ”when granting the license to Previpaz SL, already with the number two of Ricardo Sánchez, Juan Manuel López, at the head of the Mairenero City Council.
The judge maintains that the family business project of the member of the Executive of the Andalusian PP has “benefited from this prevalence achieving an unusual and infrequent extreme administrative diligence, in the issuance of technical, legal and resolutions ‘all favorable’ reports ‘all favorable’ in a very Short space of time “, despite” the repeated breaches “incurred by the company when requesting licenses and carrying out the works, as the Judicial Police confirms in their investigation.
All this leads to an alleged crime of administrative prevarication (punished with the penalty of special disqualification for employment or public office), considering “irregular” the issuance of the resolutions associated with it. According to the report, the local administration “grants the major work license knowing that it had not been fulfilled in a timely manner” the legally required hearing process.
The judge, guided by the Civil Guard report, also incorporates the crime of urban prevarication (punishable by one year and six months to four years), since the promoter carried out “the works of the renovated bar/cafeteria /kitchen and the crematorium oven installation area, without the mandatory work license or responsible declaration ”.
The head of the court that leads this case concludes the judicial resolution citing Ricardo Sánchez to appear on March 3 as investigated. The next day, he is summoned to declare the current popular mayor of Mairena del Alcor and for March 13, Francisco Rodríguez Roa is summoned, as agare , Finance and Employment of the Executive of the Popular Party of Andalusia and counselor of RTVA by designation of their party. The rest of the investigated will appear before the judge between the 14th and 18th of that same month.
