The instructor notifies the Government that he violated the Schengen Code
The head of the Court of Instruction number 7 of Zaragoza has rejected the request of the State Attorney to archive its investigation into the entry into Spain of the leader of the Polisario Front, Brahim Gali, on April 18, in which the former minister is being investigated of Foreign Affairs, Arancha González Laya.
In his order, the magistrate accuses the Government of “frontal violation” of the Schengen regulation for allowing the entry of Gali and ugly that it relied on humanitarian reasons to facilitate its entry, ignoring that they had to have informed the rest of the Member States of this maneuver . “So far there are reasons to believe that the one made of such a basic rule has not been a bad or difficult interpretation, but a frontal violation of its precepts by having claimed its inapplication, this being the reason why what happened at headquarters is questioned criminal and not in another jurisdiction, “insists the judge.
The Schengen regulation – which affects the borders of the member countries of the European Union – says that a valid visa is necessary to cross them, unless the person is the holder of a residence permit or a long-term visa. The legal services of the Executive, which represent González Laya and his ex-right hand, Camilo Villarino, have always defended that there is no criminal offense because Ghali has a Spanish DNI and because, in addition, the law allows them to free him from going through customs control, as stated in article 5.2 of the code.
