Admits the complaint filed by the Prosecutor’s Office and appreciates eight acts suspected of constituting crimes of prevarication, influence peddling and disclosure of secrets / use of privileged information
The head of the Court of Instruction number 1 of Cartagena has admitted to process the complaint of the Anti-Corruption Prosecutor for an alleged corruption plot in the Port of Cartagena and has begun the process to take a statement as investigated from the current president, Yolanda Muñoz, her predecessor, Antonio Sevilla, seven other people and the legal representatives of two contractor companies. The cause includes the apparent favoring of companies and people related to these high positions in the awarding of contracts and public jobs between 2014 and 2021. Muñoz and Sevilla have denied any irregularity.
As reported on Wednesday by the Superior Court of Justice (TSJ), the magistrate has agreed to initiate proceedings in relation to the complaint by the Murcia Region Prosecutor’s Office about irregularities and favorable treatment in certain contracts with the Cartagena Port Authority.
The order, notified this Wednesday to the Prosecutor’s Office, orders that nine investigated persons and representatives of two commercial companies be transferred to be informed of the facts attributed to them, as well as their right to examine the proceedings, to act in the process and appoint a lawyer before their statement is taken.
“The investigative proceedings of the Public Ministry would have begun a year ago in view of the preliminary investigation carried out by agents of the Economic and Fiscal Crime Group of the National Police after the complaint of three individuals,” said the TSJ. And he added that, “according to the substantiation of the order, the facts resulting from the complaints present characteristics that suggest the possible existence of very diverse crimes,” He cited “misrepresentation, influence peddling, disclosure of secrets/use of privileged information , negotiations and prohibited activities and falsification of public documents”.
Specifically, the resolution lists eight facts that “have minimal and sufficient evidence of the alleged commission of various criminal offenses and that justify the need to initiate Preliminary Proceedings in order to clarify them,” the order indicates.
