What is done when a judge violates the letter of the law that he should apply? For example, write a complaint on the website of the General Council of the Judiciary, which has received 14,000 complaints as of Thursday due to the conduct of Judge Adolfo Carretero in his interrogation of Elisa Mouliaá. I say until Thursday because that day the website crashed and stopped recording the protests. In all of 2024, it received 16,000 complaints. It is clear to what extent the actions of that judge have contributed to the discredit of justice in Spain.
Mouliaá’s complaint against Íñigo Errejón has taken us back to the past, not too distant, in which judges made the victim guilty. Or at least suspicious. All in the not very complicated exercise of giving evidence for the facts. It is legitimate for the investigating judge to review every detail and even question possible contradictions. This is what should be done with any witness, including the complainant. What the law does not allow is to intimidate the woman on the basis that she provoked the crime with her attitude.
