The former vice president of the Court of Justice of the European Union (CJEU) Rosario Silva, the first female State lawyer in Spain, has advocated for judicial independence, recalling that this guarantees legal certainty and the principle of legality.
The judge, who has participated in the Third Congress of the Civil and Commercial Court of Arbitration (CIMA), has also asserted that “fundamental rights are at the heart of the European Union” and that the CJEU unequivocally maintains the immovable pillars of the rule of law.
Also the professor and emeritus magistrate of the Constitutional Court Manuel Aragón has defended “the independence of the Judiciary within the separation of powers, because without it the Rule of Law is not possible.” Aragón has criticized the “abuse of the use of the Decree Law to legislate, contrary to the provisions of the Constitution.”
Likewise, he has commented that private arbitration “is not a substitution of the jurisdictional function, but rather a collaboration with it” and has advocated “extending its use within the Law and with respect to it.”
The president of CIMA Juan Serrada, for his part, has pointed out that “we have been pioneers in the construction of an arbitration system that has strengthened economic and commercial relations in Spain, attracting investments.”
Serrada has congratulated himself on the achievement of the creation of the Madrid International Arbitration Center – Ibero-American Center of Arbitration (CIAMCIAR) with the participation of the Court of Arbitration of Madrid (CAM), Spanish Court of Arbitration (CEA) and Court Civil and Commercial Arbitration (CIMA) and the Illustrious Bar Association of Madrid (ICAM) as a strategic partner.
For his part, Alfonso Iglesia, president of the Ibero-American Arbitration Club (CEIA), has assured that “arbitration is synonymous with prosperity and economic strength” and has valued the capacity of the self-composition of the parties in conflict to take control of the resolution of their disputes”. Iglesia has been convinced of “Madrid’s ability to be the benchmark for Ibero-American arbitration”.
For his part, the mayor of Madrid, José Luis Martínez Almeida, thanked CIMA for the invitation to preside over the opening ceremony of the III Congress “both in my capacity as a jurist and as mayor.” Almeida stated that “arbitration is a fundamental pillar of the rule of law” that manages to resolve disputes “effectively in reasonable times” and showed the “institutional and economic” commitment of the City Council to ensure that “Madrid is the reference for arbitration.” in Spanish”.
Finally, the State Attorney General, David Vilas, has highlighted the progress that commercial and investment arbitration has made in the tasks carried out by the State Attorney’s Office. And he has pointed out that through this procedure, in the case of disputes over renewables, the State’s bill has been reduced from 10,000 to 1,500 million.
