The Court of Instruction number 5 of Cádiz has sentenced six people for smuggling and membership in a criminal grouplinked to the murder of two civil guards in Barbate with a drug boat. It is the boat of ‘Kiko the Goat’, but the authorities have already ruled out that it was responsible for the deaths of the agents. Furthermore, none of the six crew members will go to prison, since the prison sentence has been suspended following an agreement between their lawyers and the Prosecutor’s Office.
The ruling establishes sentences of two years in prison for three defendants, considered crew members of the drug boat, and one year and seven months for the boat’s mechanics. In addition, fines of between 82,000 and 100,000 euros were imposed on them.
The events occurred in the month of February, when three of the accused boarded a boat in Sanlucar de Barrameda to receive transport orders from a criminal leader. The boat, equipped with four high-power engines, had technical problems and took refuge in the port of Barbatewhere mechanics carried out repairs.
During the stay in the port, Civil Guard agents monitored the presence of other suspicious vessels. Meanwhile, a drug boat rammed a zodiac of the body, causing the death of two agents and several injuries.
After leaving Barbate, the accused went to Sotogrande and The Linewhere they were detained. Subsequently, they acknowledged their participation in crimes related to drug trafficking and provided information about criminal activities in the port of Barbate.
The agreement with the Prosecutor’s Office allowed the accused to be released after accepting their involvement. This pact contemplated their collaboration and assured that they would not serve prison sentences, unless they relapse.
The final sentence attributes smuggling crimes to all defendants and membership in a criminal group to three of them. The judge also assessed collaboration and repentance of the accused as mitigating factors in their resolution.
Finally, the custodial sentences are suspended for two years for five of them and three years for the pilot, due to his background. During this time, They will not be able to commit new crimessince otherwise they face effective compliance with their sentences. The ruling is final and does not allow appeal.
After ruling out the ‘Kiko el Cabra’ drug boat, the authorities are now focusing on another boat seized in March by the Huelva Civil Guard, south of the beach of Antille. This boat, with 94 bottles of gasoline and damage consistent with the crash, became the main objective of the investigation.
In September they arrested the alleged pilot of the drug boat and this month they captured two alleged crew members. According to the investigation, there was a fourth companion, who has not yet been identified by the authorities.
