The Superior Court of Justice of Extremadura has condemned the Board to compensate more than 26,000 euros to the parents of José María Piris Carballofirst child murdered by the terrorist group ETA.
José María Piris Carballo was born in San Vicente de Alcántara in 1966, but was murdered at the age of 13 in the Guipuzcoan town of Azcoitia on March 29, 1980 where his parents emigrated seven years ago. The minor took the package bomb without knowing what it was when he was accompanied by his father and his 11-year-old friend, Fernando García López, when leaving a soccer game. That March 29, 1980, ETA claimed the first of its 22 child victims throughout its armed activity.
Carballo He manipulated the bag that had explosives and was placed on the underside of a vehicle belonging to a member of the Civil Guard. The vehicle did not explode because the mechanism failed, the package bomb fell to the ground, and the 13-year-old boy, very curious, approached to see what was in its contents. That was when everything exploded, Carballó was thrown about three meters and his colleague was seriously injured with eye injuries. The device was placed by an ETA commando.
The Contentious-Administrative Chamber has upheld the appeals of Carballo’s parents against the resolution of the Department of the Presidency that Last year it denied compensation for not meeting the required requirements.
It condemns the Junta of Extremadura to pay compensation of 13,118.14 euros plus legal interest from the date of the request until its payment in addition to the costs, a total that ranges to more than 26,000 euros as consequences of the terrorist act protection of Law 2/2020, of March 4, of support, assistance and recognition to Victims of Terrorism of the Autonomous Community of Extremadura. José María Piris Carballo received a tribute this summer in the Badajoz town of San Vicente de Alcántara and a monolith was inaugurated in his honor 44 years after his murder with the inauguration.
The Board has specified that they will not appeal the sentence before the Supreme Court and will pay compensation. “It has not been possible to compensate the family with politics, with the application of the Extremaduran law, but I am satisfied that Justice has been able to do it,” said the advisor to the Presidency, Abel Bautista.
