The General Directorate of Traffic (DGT) has opened an investigation with the aim of locating the authors of the vandalization of seven radars located on different conventional roads (2 in the Community of Madrid, 2 in Castilla-La Mancha, 2 in Castilla and León and 1 in the Valencian Community) and thus undertake legal actions against them.
Through a Communiqué published on the website of the Ministry of Interior, it reports that the vandalization of the radars is a violation of the Criminal Code in its articles 263 to 267, since “they cause a impairment in the patrimonial value of the property of others and whose protected legal good is the heritage.”
Article 263.2 contemplates an aggravated type of the crime of damage that provides for penalty of 1 to 3 years prison and fine of 12 to 24 monthsthat is committed when the following circumstances concur, indicative of the author’s intention to cause more serious damage: “When the damage aims to prevent the free exercise of authority or are carried out as a result of the actions executed by the authority in the exercise of their functions. Also when they are committed against public officials, or against individuals who, as witnesses or in any other way, have contributed or can do so in the execution or application of the laws. “
The authors of the facts must also fines in order to cover the economic cost of each radar: in the case of fixed radars it amounts to some € 67,000 and in the section of stretch to some € 66,000.
“Both the agents of the Civil Guard Traffic Association and those of Citizen Security will reinforce surveillance at the points where the radars are installed to prevent this type of acts from occurring. In addition, surveillance cameras have been placed the same directly connected to the DGT management centers in order to detect possible sabotage and allow the immediate action of the Civil Guard patrols “sentenced the statement.
