The Prosecutor’s Office claims for the septuagenarian, who will be tried by a popular jury, sentences that add up to 28 years and five months in prison for alleged crimes of murder – with the aggravating circumstance of kinship and gender reason -, threats and habitual ill-treatment. He also requests that he be prevented from having or carrying weapons for seven years.
The Public Ministry, in its brief of provisional conclusions, maintains that the 71-year-old suspect subjected his wife, Rosalía -with whom he had been married for 38 years-, to a hell of habitual ill-treatment. Since 2015 both were separated but continued to live under the same roof in the company of their daughter. On September 7, 2018, the couple had a heated argument during which Juan M. allegedly cornered his wife against the wall and told her “I’m going to kill you.” After these events, the woman took refuge for a few days at her sister’s house.
Once she returned to the family home, the prosecutor maintains, Rosalía was isolated to the point that neither her husband nor her daughter spoke to her or shared food or housework with her. The defendant and the common daughter supposedly appropriated a large part of the rooms of the house, not allowing the victim to enter them.

The woman, moreover, did not have a job and during the relationship she dedicated herself to caring for the family and the home, depending financially on Juan. The defendant, explains the prosecutor, aware of this situation, canceled in November 2019 the credit card that her wife had, having her have to ask her brothers for help to meet her basic needs and pay for medicines. that I had prescribed.
Compensation only for siblings
On July 20, 2020, the prosecutor continues, the defendant was aware of the divorce ruling that was favorable to Rosalía’s interests by attributing the use of the home to her and forcing the defendant to pay her a compensatory pension of 700 euros. The Public Ministry maintains that the result of the divorce sentence caused an anger in the accused that led him, on the morning of July 21, 2020, to appear in the office of his lawyer uttering threats and insults against him.
Around 12:30 p.m. on July 22, the couple met at the house and, the prosecutor explains, when she made a comment alluding to the resolution, Juan grabbed a hammer and, taking advantage of the fact that his ex-wife had her back turned, allegedly hit her several times on the head. . The attack caused Rosalía to be transferred to the Intensive Care Unit (ICU) of the Virgen de La Arrixaca hospital in Murcia, where she died 28 days later.
The prosecutor demands, in addition to prison sentences, that the defendant be forced to compensate the victim’s brothers in 80,000 euros. The Public Ministry considers, however, that there is no compensation for the woman’s daughter since “she did not maintain any maternal relationship despite living in the same address, having failed to comply with the duties of respect and help to support the charges relatives”. It also requests that the accused pay the 35,166 euros that the Murcian Health Service spent on caring for the victim.
