The Constitutional pursues the Macías magistrate from all deliberations on the amnesty law

The Plenary of the Constitutional Court has resolved to separate one of its magistrates, José María Macías, of all resources filed against the amnesty law, they inform sources of the Court of Guarantees. Macías, appointed at the proposal of the Popular Party, had already been challenged in the challenge that the Supreme Court made of the amnesty law, but had decided not to voluntarily depart from the rest of the resources referring to the aforementioned law, including the one presented by the PP.

José María Macías was a member of the General Council of the Judiciary until his appointment as Constitutional Magistrate in July last year. In his stage in the governing body of the judges, Macías headed the opposition of the agency’s conservative sector to various initiatives of the Executive, especially to the Amnesty Law, coming to force the issuance of a report contrary to the law. This initiative, according to the Plenary a week ago at the request of the Prosecutor’s Office, was sufficient to understand that it should not participate in the debates about this law by having already formed a criterion “to the detriment of due impartiality”.

In the plenary on Wednesday, Macías has been separated with the votes in favor of the progressive sector of the Constitutional, majority in court. They have announced the formulation of particular votes to fix their opposite position to separate Macías also the conservative magistrates Ricardo Enriquez, Enrique Arnaldo, Concepción Espejel and César Tolosa.
