The Constitutional Court admits the PP’s appeal against the amnesty for processing and maintains Judge Macías as rapporteur

The Constitutional Court has accepted the Popular Party’s appeal against the amnesty law and has accepted that Judge José María Macías, who actively opposed the law when he was a member of the Judiciary, will be the speaker of the sentence. The plenary session, unanimously of all its members, has rejected the challenge presented by the State Attorney’s Office, considering that it is “premature.” They still have to study a similar request to remove Macías filed by the Prosecutor’s Office but in other resources.

In recent weeks the guarantee court has received around twenty appeals and challenges against the amnesty law. Several of them have already been admitted for processing, such as the question of unconstitutionality presented by the Criminal Chamber of the Supreme Court, and there are more than a dozen appeals from the autonomous communities and regional parliaments governed by the PP pending to pass this first procedure.

The appeal from Alberto Núñez Feijóo’s party that has just been admitted for processing is, according to court sources, the most relevant because it is the one that covers the most within the amnesty law and the one that will lead the way for the rest of the appeals. The speaker, José María Mácias, had been challenged for having led the opposition of the conservative sector of the General Council of the Judiciary to the law when he was a member of this body. The plenary session still has to study a challenge against Macías raised by the Prosecutor’s Office in another of the appeals that have been admitted for processing.

In a statement, the full court of guarantees explains that the Attorney’s challenge was presented even before the PP’s appeal was admitted for processing and that implies its inadmissibility. “It determines the inadmissibility of the challenge raised due to its premature nature, as it was formulated outside the deadline,” it explains in the text.
