The National Markets and Competition Commission (CNMC) has agreed with Vodafone in the conflict that it had been dragging on for three years with the operator Madfibra due to non-payments and non-compliance with the conditions of deployment of its wholesale contract.
The CNMC has issued a resolution approving Vodafone’s request to act against Madfibra for having deployed its network in the Madrid neighborhood of El Cañaveral without respecting the agreed conditions neither in time nor in form and without paying the invoiced amounts, with a “significant debt.”
Vodafone notified the CNMC that the Madrid independent operator has repeatedly ignored its regularization requirements. For its part, Madfibra has acknowledged to the regulator the irregular occupation of the network in terms of deployment times, but has alleged that is not proceeding to pay Vodafone the contemplated prices in the wholesale contract because they are excessively high.
In its resolution, the CNMC agrees to consider Vodafone’s request and authorizes it to suspend the access service now urge the removal of fiber optic cables in their physical infrastructuresin the event that Madfibra does not proceed to regularize its occupations and pay the outstanding debt.
On the other hand, Competition has also ruled in favor of Vodafone in response to a complaint it received last June from the Audiovisual Council of Andalusia for Do not broadcast afternoon territorial disconnections on your television service of RTVE in the province of Cádiz.
Vodafone alleged signal quality problems and decided to modify the broadcast of the La1 channel, moving it to dial 906 and broadcasting in its place on dial 1 the state signal offered by TVE, which contains programs of general interest in the time slots with regional disconnection. The operator also argued that its users have the possibility of accessing these territorial contents through the ‘RTVE Play’ app that is integrated into their decoders.
The CNMC has decided file the complaint because the current audiovisual regulations do not require Vodafone to broadcast the territorialized signal in Cádiz.
