Abortion is no longer a constitutional right in the United States. The Supreme Court, with the decision of June 24, 2022, cancels the ‘Roe v. Wade’ sentence which since 1973 has guaranteed the right of women to terminate their pregnancy. The decision of the Supreme Court, with 6 judges in favor and 3 against, hands over the matter to the individual states: each state will be able to apply its own law on abortion. “It’s a tragic mistake that sets America back 150 years,” said President Joe Biden rejecting the decision of the judges without appeal.
THE SUPREME COURT: “THE CONSTITUTION DOES NOT GUARANTEE THE RIGHT TO ABORTION”
“The Constitution does not guarantee a right to abortion”, we read in the ruling supported by the conservative majority of the Supreme Court. The 6 judges reiterated that “the authority to regulate abortion returns to the people and to the elected representatives”, that is to say, it authorizes States the possibility of prohibiting it. “Roe was blatantly wrong from the start,” Judge Samuel Alito wrote in the majority opinion referring to the 1973 ruling. “Her argument was exceptionally weak, and had damaging consequences – he wrote again – and rather than bringing about a national agreement on the issue of abortion has inflamed the debate and increased divisions. “
ABORTION, NOW THE STATES DECIDE
The six conservative judges upheld the law, passed by Mississippi, banning abortion after the first 15 weeks, which is contrary to what was established by Roe, which makes it possible for up to 24 weeks. There are over twenty states, mostly in republican-led states in the South and Mid West, which have approved restrictive laws on abortion or outright bans. Laws that were in fact legitimized by the Supreme Court’s decision. A sentence that represents a historic victory for the American conservative and pro-life movement that has worked in this direction for years.
“This is a monumental day for the sanctity of life,” tweeted Missouri Attorney General Eric Schmitt, announcing that “following the Supreme Court decision to quash Roe vs Wade, Missouri is the first to end the ‘abortion”. “It is a historic day, but we remember the 60 million innocent lives lost – added Schmitt who posted the photo while signing the measure – there was a lot of work behind the scenes to achieve this incredible victory”.
For 13 states – Arkansas, Idaho, Mississippi, Missouri, North Dakota, Kentucky, Louisiana, Oklahoma, South Dakota, Tennessee, Texas, Utah, and Wyoming – the laws provide that the ban on abortion comes into effect practically immediately. Arkansas, Oklahoma, Missouri and South Dakota have already certified the turning point in different ways.
Then there is another group of states – Georgia, Idaho, Iowa, Michigan, South Carolina, Texas, West Virginia, Alabama and Ohio – that also have laws to ban abortion, but those provisions wouldn’t go into effect right away. In Ohio and Georgia, in particular, the process was started.
BIDEN: “AMERICA GOES BACK 150 YEARS”
Joe Biden spoke on “a sad day for the country and the Supreme Court”. The college “took away a constitutional right from Americans, a right already recognized,” added the president of the United States.
“The health of the women of this nation is at risk. There will be real and immediate consequences,” Biden said. The Supreme Court decision on abortion “is a tragic mistake, the realization of an extreme ideology,” Biden said, denouncing that “three judges appointed by a single president, Donald Trump, are at the heart of the decision that overturns the scales of justice and eliminates a fundamental right for the women of this country. This decision is the culmination of a deliberate decades-long effort to overturn the balance of our law. “
With the decision of the Supreme Court will come laws “that criminalize abortion with a logic of the 1800s, the Court has literally set America back 150 years”. The judges’ decision “cannot be the last word” and, although it has made the United States “an anomaly among the developed nations of the world”, it is still “not over,” the president said, calling for a Congressional intervention. “Let me be very clear and unambiguous. The only way we can guarantee a woman’s right to choose is for Congress to restore Roe v. Wade’s protections as federal law. No executive action by the president can do that,” he said. Biden explained.
TRUMP: “A VICTORY FOR LIFE”
The Supreme Court decision has, in a sense, also the signature of the former president Donald Trumpwho appointed 3 of the 6 judges in favor of the rejection of the Roe v. Wade ruling.
The court’s ruling “is the greatest victory for life in a generation,” said Trump, noting that the result was achieved “only because I have accomplished everything I have promised, including the appointment of three highly respected constitutionalists and their confirmation to the Supreme Court “. “It was a great honor” to have chosen judges Brett Kavanaugh, Neil Gorsuch and Amy Coney Barrett, he said. According to the New York Times, however, Trump has confided to friends and advisors that he does not consider the sentence a good thing because it could have negative electoral consequences for Republicans.
