When the cleaning of a certain stretch of road has to be carried out, the owner body can institute a ban on temporary parking. Heavy fines are foreseen for offenders, but the signage must comply with specific requirements
Cleaning the city streets is not only a symptom of civilization, but also contributes to safety and even to the healthiness of the air. Eliminating risk sources such as oil stains or slippery materials helps prevent accidents, removing dust generated by vehicles, both those coming out of the exhaust pipe and those caused by brakes and tires, prevents these from being raised by passing traffic and ending in the lungs of citizens. Generally this is an activity carried out at night, when the passage of cars is less, but to be carried out correctly, the streets being cleaned must be clear of vehicles. The municipalities provide for specific parking bans on established days and times and those who transgress are sanctioned. Let’s see how it works.
WHAT THE CODE SAYS

Article 6 of the Highway Code in paragraph 2 governs the prohibition of overnight parking for street cleaning, a faculty that allows the owner of the road to temporarily prohibit parking on roads or stretches of roads for technical or cleaning. The prohibition must be adopted through an ordinance of the mayor and notified at least 48 hours in advance by means of signs and other appropriate means. If the prohibition is recurring, the signs that prescribe it are of the fixed type, if instead it is occasional, the signs will be of a temporary type. It is good to remember that the latter type of signage has priority over the fixed one. Therefore, if parking is normally permitted on a certain stretch of road and a temporary ban is encountered, it is the latter that prevails. If the prohibition sign is missing, or if it has not been placed in due time, it is possible to challenge the sanction and appeal to the Prefect or the Justice of the Peace.
FINE AND REMOVAL

Failure to comply with the parking ban for street cleaning entails an administrative penalty of between 42 and 173 euros. Furthermore, art. 159 of the Highway Code prescribes that the Municipalities and other entities owning the roads may order, in addition to the fine, the forced removal of non-parking vehicles. In this case, the no-parking sign must be accompanied by the additional panel indicating removal.
