The third group of the Supreme Court of Justice (STJ) decided this Tuesday (23) that condominiums can prohibit owners from renting their properties by season, such as those carried out by Airbnb.
The ministers tried a case of a condominium in Londrina, Paraná, where one of the owners filed a lawsuit after the condominium approved the ban on leasing the properties for less than 90 days.
The owner won at the first instance, but lost in the Court of Justice of Paraná (TJ-PR), which took the case to the STJ, informs the Extra portal.

For the ministers of the STJ, there is no illegality in the restriction placed by the condominium and this type of lease can affect the peace and security of the place due to the high turnover of people.
Minister Marco Aurélio Bellizze asked that the minimum quorum for this type of decision in a condominium meeting be two-thirds.
