The Federal Supreme Court (STF) determined on Thursday, 5th, that the National Environment Council (Conama) issue a new, more protective resolution on air quality standards. The deadline given by the ministers is 24 months.
The ministers were unanimous in considering that the regulation in force is very permissive regarding levels of pollution and that it is necessary to update the regulatory criteria to follow the most recent guidelines of the World Health Organization (WHO), published in September last year.
Although all have assessed that there are problems with the regulation in force, the ministers were divided when analyzing whether the current resolution should be declared unconstitutional. Most concluded that there was no irregularity at the time in editing the text, but that today it is outdated.
“What was edited did not necessarily violate the Constitution, what was not edited did. That is, it fell short. Especially because, in terms of environmental protection, achievements are always provisional”, defended Minister Alexandre de Moraes. In addition to him, ministers André Mendonça, Kassio Nunes Marques, Ricardo Lewandowski, Dias Toffoli, Gilmar Mendes and Luiz Fux also voted to declare the current resolution valid.
Minister Cármen Lúcia, rapporteur of the process that makes the agenda of the “green agenda” under analysis in the STF, inaugurated the votes still in yesterday’s session and suggested declaring the norm unconstitutional. It had also proposed a shorter timeframe for compliance, 12 months.
In the minister’s assessment, the resolution “represented an advance”, but “does not fully comply with the constitutional duty of efficient protection of the right to an ecologically balanced environment, nor the right to health, nor the right to information”.
“The resolution does not contain effective instruments for the Ministry of the Environment, Conama and the States to evolve in achieving better air quality standards and, therefore, adopt a set of measures necessary to reverse this situation. dramatic in relation to what is life itself: the act of breathing in a way that is coherent with the health conditions that are provided as long as the measures are adopted”, he defended.
Ministers Edson Fachin and Luís Roberto Barroso accompanied the rapporteur and were defeated. Rosa Weber voted for unconstitutionality, but was in favor of the extended term of 24 months.
“As the environmental impacts that are produced today will only generate their negative consequences in the next generation, government authorities often move towards short-term valuations, which politics often imposes, and procrastinate those solutions that are indispensable”, pointed out Barroso.
The action against the Conama resolution was proposed by the Attorney General’s Office (PGR) in May 2019. At the time, the Attorney General of the Republic, Augusto Aras, had not yet taken office. When speaking at the trial, Aras changed the position of the body and defended the validity of the measure.
