The Criminal Court number 2 of Jaén has sentenced the owners of a dog puppy to three months in jail to which for at least 15 days they kept tied in a farm in Alcalá La Real (Jaén) without supplying food or water. They did it in the middle of December when the animal, because of how short the chain had, not even managed to cook in the booth.
The sentence collected by Europa Press indicates that the events date back to December 2022 when the Civil Guard in a rustic farm of the Cascante place located the German Boxer-Pastor breed puppy that presented “an extreme thinness and a famous appearance, with obvious physical symptoms of malnutrition and dehydration”.
It was the Civil Guard agents themselves who at first provided “with urgency” water and food to the animal that was surrounded by excrement and “in a certain possibility of death” if the lack of care had been prolonged.
The animal was transferred to this farm by the two defendants and there they left him tied with a chain around his neck, which presented a knot to a cable on the floor that limited the extent of the chain to 50 centimeters, which prevented him from displacements.
The farm was fenced in its entire perimeter with a metal fence of a meter and a half high. The sentence points out that the two defendants left the animal there knowing “the vital dependence that the puppy had of their care and the supply of water and food to subsist.”
He adds that the owners acted “with absolute contempt” towards the life of the animal and that with their way of proceeding they omitted “repeatedly” the fulfillment of the obligations imposed by the Law on the Protection of Domestic Animals.
“They have not provided the necessary food and water for their food and subsistence, they have not sought the care that it required neither the sanitary and appropriate hygienic conditions and have kept it uninterruptedly tied by the neck to a chain,” says the sentence.
In addition, of the three months in jail for each of the defendants, the sentence disables them for a year for the exercise of profession, trade or trade that is related to animals and their possession.
The sentence, which is already firm and in which they are sentenced to coast, has been issued for compliance after the two defendants recognized the facts and accepted the penalty proposed by the Fiscal Ministry.
The Court has also agreed to suspend the penalty for two years, with the warning that they cannot commit crimes within that period since it would be revoked such suspension.
