This behavior escalated until touching the minor’s genitals, with sexual access, on multiple occasions.
During the time the abuse lasted, the girl did not tell what was happening to her “because she was afraid, feeling pressured and afraid because he told her that no one was going to believe her, that her grandmother loved him more than her and that everything was consensual.” As a result of these events, the minor suffered psychological damage for which she underwent psychological treatment.
For this reason, the Court condemns this man for a continuous crime of sexual assault with carnal access through the vaginal introduction of bodily members, the victim being under 16 years of age, for which the author used intimidation and took advantage of a situation of prevalence. It is also imposed the prohibition of approaching the victim within 500 meters for 16 years. An appeal is possible.
