The Senate approved today (24) a bill (PL) that gives the club that hosts football matches the so-called arena rights, referring to the transmission or reproduction of games. In this way, the home club of the match will have the prerogative to negotiate its transmission. The project had already passed through the Chamber and is now going for presidential approval.
The arena right for home clubs had been the subject of a provisional measure (MP) edited by the federal government last year, but it has expired without being considered by Congress. President of the Chamber at the time, Deputy Rodrigo Maia (DEM-EJ) understood that the provisional measure was not the most appropriate instrument to deal with the issue and did not guide its vote.
The text provides for a ban on stations that broadcast the games to sponsor clubs and establishes that 5% of the revenue from the games will be distributed, in equal parts, to players (owners or reserves) within 72 hours. An important change in relation to the MP edited last year determines that the PL will not reach contracts already signed. This was one of the main complaints of television stations that already had contracts signed to broadcast national and state championships.
Currently, the arena right belongs to the two teams participating in a match, which requires the consent not only of the home team, but also of the visiting team to be televised. Thus, a broadcaster needs to negotiate the rights with the two teams to make the transmission viable. The rapporteur of the matter in the Senate, Romário (PL-RJ), explained in his opinion that the PL creates a specific rule for football.
“With the proposal of the project under analysis, a specific rule is created for the soccer modality, in which the arena right belongs only to the commanding team of the field. This creates the possibility that a team negotiates directly with broadcasters and media companies interested in all the matches of a competition in which it is principal”, explained the reporter. In cases where there is no “home team”, such as in charity, commemorative or friendly matches, the text of the project provides for the validity of the previous rule.
