Minister Flávio Dino, of the Federal Supreme Court, raised the tone and reprimanded the Executive and Legislative Powers by scheduling another public hearing on the end of the secret budget. Dino reiterated that it is “absolutely incompatible” with the Constitution and with the harmony between the powers that a decision by the highest Court – which declared the scheme revealed by the Estadão – has not yet been adequately complied with, two years after the aforementioned judgment.
The minister highlighted that the process, in the STF, regarding the secret budget, has no end date and will last “for the time necessary to adapt budgetary practices to the dictates of the Federal Constitution”.
“Complying with the due budgetary process, constitutionally enshrined, is not a political or administrative choice, but rather a fundamental duty imposed on the three Powers of the Republic”, he stressed.
In an order signed this Monday, the 30th, Dino scheduled the public hearing on the secret budget for October 10th. The minister signaled that after the hearing he should analyze the request for partial resumption of the execution of the secret budget estate.
The rapporteur suspended the application of resources from the rapporteur’s amendments and commission amendments – mechanisms of the scheme revealed by Estadão – until there was total transparency of the transfers. He indicated that he must decide on works actually in progress, which depend on the paralyzed resources, as long as they comply with appropriate rules.
During the meeting, the information actually available on the rapporteur and committee amendments will be discussed, which will be passed on to the Comptroller General of the Union, to be made available on the Transparency Portal.
In addition, the Federal Attorney General’s Office and the Chamber and Senate Attorneys’ Offices will present their proposals for restructuring and reorganizing the amendments to the secret budget for 2025.
According to Dino, the proposals must follow the transparency parameters and the Comptroller’s diagnosis of the cities that benefited most from secret budget resources. The minister indicated that the report highlights “serious non-conformities in the preparation and execution of the amendments”.
As shown by the Estadãothe CGU listed works that had been stopped and pointed out problems with the criteria for choosing works financed with resources from the secret budget.
