Joana Ribeiro Zimmer was promoted and transferred from region to region; change was decided before case was revealed
Judge Joana Ribeiro Zimmer, who prevented an 11-year-old rape victim from having an abortion, dropped the case. The magistrate was promoted and left the district of Tijucas, in Santa Catarina, where she worked.
The promotion was on June 15, before the case was revealed by The Intercept Brasil on Monday (June 20). She took over the region of Brusque, also in SC.
Zimmer decided in May to keep the child in a shelter in Santa Catarina, preventing her from having access to an abortion procedure.
The Court determined on this 3rd (June 21, 2022) that the child returns to live with the mother. The CNJ (National Council of Justice) is investigating the judge’s conduct.
“The Corregedoria Nacional de Justiça informs that the facts related to the conduct of Judge Joana Ribeiro Zimmer, in relation to the judicial process that is being processed in the district of Tijucas/SC, are being investigated in a disciplinary complaint”detailed the organ.

On May 4, the girl’s mother took her to the Professor Polydoro Ernani de São Thiago University Hospital, linked to the UFSC (Federal University of Santa Catarina), to perform the abortion. At the time, the girl was 22 weeks and 2 days pregnant.
Hospital staff refused to do the procedure. A hearing on the case was held on May 9. Excerpts were published by The Intercept on Monday (June 20).
In the recording, the judge tries to convince the girl and the mother to keep the pregnancy. “Would you like to stay a little longer?”said Zimmer, according to a report by The Intercept.
