The bicycles electric they are more and more widespread. As i cyclists discover the ability to cycle with less physical exertion or venture into longer journeys, the industry of e-bike is booming. And with worries about theincrease in fuel prices and the climate changemore and more people use electric bicycles like alternative means of transport for daily activities.
However, bicycle laws and regulations they are trying to catch up with the wave of electric cyclists. Recently the Infrastructure decree lawapproved by cabinet last June 15th, modified four points relating to article 50 of the Highway Codewhat disciplines bicycles e electric scooters.
Two new reforms are born, the first dedicated to the establishment of e-bike for freight transport and the second focused on fines for those who modify electric cycles.
E-bike modified for transport, what characteristics should it have?
Regarding the emergence of a category of e-bike used for the transport of goods, Article 50 of the CdS states that “The cycles used for the carriage of goods must have an approximately flat and horizontal loading surface, open or closed, corresponding to the following criterion: length of the loading surface × width of the loading surface ≥ 0.3 × length of the vehicle × maximum width of the vehicle“.
It means that the cycles intended for the transport of products, they must have a compartment for storing objects or cooler bags if it is a question of transporting food and drinks.
The modification allowed is the increase in power, with the possibility of obtaining the double the power of a normal electric bikemaking it rise from 0.25 to 0.5 kW.
However, the electric motor will have to stop working once the i 25 km / h.
Rigged e-bike fines, penalties for those who produce and market
The new law decree states that: “Whoever manufactures, produces, markets or sells pedal assisted cycles that develop a speed higher than that provided for in paragraph 1 are subject to the administrative sanction of the payment of a sum from 1,084 to 4,339 euros. To the sanction from 845 a 3,382 euros it is subject to those who perform on pedal assisted cycles changes suitable for increasing the maximum continuous rated power of the electric auxiliary motor or the speed beyond the limits provided for in paragraph 1. “
If you were to exceed the limit of 25 km / h without turning off the electric motor, you risk sanctions from € 1,084 to € 4,339.
E-Bike rigged, fine to the cyclist
Not even cyclists are exempt from sanctions. An amendment to Article 50 states that electric cycles are to be considered like mopeds and as such they should have license plate, insurance, driving license and the driver should wear a helmet and have aminimum age of 14 years.
Furthermore, accessories must not be missing to make electric bicycles visible. Among the tools to be supplied: one front light white or yellow, one rear light red reflector and a red rear reflector, yellow reflectors on the pedals and a doorbell working.
Here, too, the fine would be around a few thousand eurosespecially when you think about the fact that being surprised at drive without a license having never obtained it may result in a penalty of 5,000 euros.
