Reiswinkel Prijsvrij has to pay more than a ton to Tradetracker, an online marketing company. Price-free, which previously took over D-Reizen stores, is refusing to pay invoices because trips were canceled due to corona. The judge finds this unjustified and orders Prijsvrij to pay the bills after all.
The argument about payments has been going on for a year and a half and revolves around commissions that Price-free has to tap into Tradetracker. The online marketing company from Almere was hired from 2014 to recruit online customers for Prijsvrij through so-called affiliate partners. These partners placed software on their site to refer visitors to their website to Pricefree.
But after the corona outbreak in March, Prijsvrij refused to pay the commissions because the trips were cancelled. Incorrect, the court says.
The East Brabant court orders Prijsvrij to pay ten outstanding invoices with a total amount of 104,000 euros. The court does not agree with Pricevrij’s reading that corona is an ‘unforeseen circumstance’ that justifies the commission not having to be settled. The court states that ‘the risk of cancellations’ lies with Prijsvrij.
Ingmar Bruinsma, director of Travelclown Group, was one of the victims and is happy with the verdict. “This is justice. I was not at all happy with the way Prijsvrij approached this. Classic display of power from a major player”, says Bruinsma.

Price-free has become involved in several proceedings. Director Marc van Deursen is feared in the industry for his tendency to settle business disputes in court. ,,For Marc, litigating is a business model”, says one of the entrepreneurs. ,,I have quite a chuckle when I read this verdict,” he says. Van Deursen has not responded to the ruling.
