Judge Mónica Aguirre, in charge of the Court of Instruction number 53 of Madrid, questioned this Tuesday the sole administrator of real Madrid within the framework of a complaint filed by a neighborhood association for the alleged commission of an environmental crime in relation to the noise pollution of the Santiago Bernabéu stadium.
This is a complaint filed by Perjudicados por el Bernabéu, which is based on the reports made by the Municipal Police of Madrid and those prepared by experts hired by the neighborhood association.
The complainants maintain that the concerts that have been held in the stadium since last July 26 “involve the “non-compliance with the urban planning license that requires the adoption of soundproofing measures”.
After concluding the hearings, a spokesperson for the neighbors denounced that the noise generated by the concerts is 2,500 times the maximum allowed, which he sees as “a real nonsense.”
“We are in this situation because someone has taken the bad decision of trying to make a business model that is not legal because you can’t even hold concerts in the stadium because it doesn’t have a license to do so and it’s also not soundproofed. “It’s nonsense,” he stressed.
Thus, he has detailed that from the association Exactly 155 noise measurements have been made in the 18 concerts that there has been, in all of them exceeding the levels of “a beastly average” as it was said on average more than 2,500 times.
“There are limits which are 55 decibels and decibels are not measured like speed, Every 3 decibels the sound power doubles. This means that in our case it has doubled 2,500 times,” he stressed.
“We understand that the City Council is the main responsible for this situation for not having prevented, as the law itself says, noise pollution. If you enter a serious risk area with 8 times more than what is allowed, what happens when we have 2,500 times “, he pointed out.
For the neighborhood spokesperson, it is not “a football problem or a Real Madrid problem, but a public health problem.”. “There is damage to the health of thousands of citizens, but we must not forget that around the Bernabéu, only in the area that we could call ground zero, there are around 800 homes, that is, about “2,000 or so people living who have suffered serious problems”he added.
The complaint is “accompanied by acoustic engineering expert reports evaluating noise immission in the outdoor environment on the occasion of the celebration of concerts in which the noise level permitted by the regulations has been exceeded”.
It is stated that “the owner had not carried out any study to prevent the release of noise during the celebration of the events” and that “in the concerts held to date the City Council received numerous complaints about unbearable noise”, exceeding the noise level.
