Lula’s coalition lawsuit questioned the broadcaster’s alleged “privileged treatment” of the then presidential candidate
Former National Justice Inspector Raul Araújo has closed a case against the former president Jair Bolsonaro (PL) and the radio Young Pan of course “privileged treatment” of the broadcaster regarding the then candidate for reelection. The action, filed by the president’s coalition Luiz Inacio Lula da Silva (PT) no TSE (Superior Electoral Court), was also brought against the former vice-presidential candidate on Bolsonaro’s ticket in 2022, candidate Walter Souza Braga Netto.
The decision to file the case was made last Friday (September 6, 2024), on the minister’s last day as a member of the TSE. The lawsuit requested that the Court investigate alleged abuse of economic and media power and the dissemination of misinformation during the electoral process. According to the petition, Young Pan treated the candidates in that year’s election unequally.
When archiving the case, Araújo points out several reasons why the case should not be pursued. The judge argues that the allegation of privileged treatment by Jovem Pan “does not hold up” when considering the diversity of voices and opinions present in its programming and says that the comments made by participants in the program did not have “significant impact” in the balance of the electoral process.
Furthermore, Araújo states that the records did not demonstrate the existence of conduct that characterized abuse of economic or political power or improper use of the media in a way that compromised equal opportunities between candidates in the electoral contest, nor that there was an illicit payment of advertising funds for the aforementioned purpose. “privilege” to the candidates.
