The template of the National Cybersecurity Institute of Spain (INCIBE) is on a war foot for its own agreement. The independent and officials union center (CSIF) has been trying to improve the conditions of the 160 highly qualified workers who make up this public company. Among its demands, that the age of employees is recognized as a complement to the base salary. The union denounces that the company wields various reasons to avoid negotiation, while the company ensures that the negotiating table of the future agreement will be constituted this February.
Incibe is a strategic center in terms of national security refers to the being the entity in charge of cybersecurity of both citizens and companies in the country. An own agreement without updating since 2011
In 2018 and 2023, new National Consulting Agreements were published again, while the INCIBE Company Agreement remained unchanged. This meant that those advances that at a first moment the agreement reported to the workforce lost their special character, since they were increasingly widespread among the sector. In 2022, the public company celebrated union elections, which won the CSIF, with five delegates, followed by CCOO, with three representatives.
According to Riesco, once the situation was analyzed, they requested several meetings with the company, which were not granted to them. “Given this answer, we denounce the agreement, so it should be suspended according to its own regulations, while Incibe would have to create a negotiating commission in less than a month,” adds the regional vice president.
For the template, the most taxing is in the non -application of the articles of the National Consulting Agreement, related to the possibility of charging a complement to seniority and a plus by agreement. “More than 10 years have passed since that company agreement was signed and the working conditions have not varied,” the same Riesco complains, which states that the first response they received from the Inciber about their demands was rejected: “We They asked for greater concretion and demanded that we contribute detailed the costs of each of the measures to be negotiated, which is the responsibility of the company, which recognized us that this study already had it. ”
At the same time, CSIF tried to register the complaint to the company agreement. To his surprise, they realized that he did not consist of the files. The agreement signed in 2011 was never legally formalized, so it is now impossible to challenge it. According to Incibe, that agreement has been added additional agreements and “is updated to the work needs of the workforce”, as they have assured eldiario.es.
Dilated negotiation
At this point, CSIF chose to promote a new collective bargaining. It was February 2024: “The company also did not create the negotiating commission and in July they told us that it was impossible to negotiate because the European elections came ahead,” adds Riesco. Once the elections have been overcome, “the new excuse was that we could not negotiate because at that time the transformation of the Inciber Company to State Public Company was being processed,” he adds.
Riesco maintains that this nominal transformation process is completely stopped. “Given the paralysis of the company, we requested again to renegotiate the original company agreement, and there they told us that it would not be equitable since right now CSIF does not have the same trade union representation of the committee that signed it in 2011, with CCOO to the head ”, Develop the trade unionist. It was already October 2024 and from CSIF they resounded to this reason: “They deny that we can negotiate improvements from an agreement signed by a different union majority. This is to leave workers in the absolute desert every time their representativeness is modified in the committee, ”the Leon’s unionist affects.
There were still a few months of swings ahead. In December last year they demanded that the negotiating commission be created for an Incibe’s own agreement. “On this occasion the excuse was that the Treasury had not authorized the beginning of the negotiations, but at the same time they tell us that they have not requested it either,” says the CSIF member.
Already this January, the reason that Infibe raised to the union representation so as not to carry out the joint table was that the company currently does not have general secretary. “There is no will here. The situation generated in this public company is totally inadmissible, with a totally outdated agreement of 2011, ”denounces Riesco itself.
Qualified personnel with low salaries
On the reality that is lived in the Neuralgic Cybersecurity Center in Spain, the union representative emphasizes that a highly qualified technician, the majority profile in the company, charges some 26,000 euros gross per year, which calls for “inadmissible.”
An INCIBE worker with seven years of experience in the entity that responds to the acronym of JFM emphasizes that it is “a very demanded staff in the market, and in the private sector technological companies offer conditions that are barely equal to public”. He believes that, if they are really interested in retaining talent in Infibe, their salary level should not be up to two and three times lower than that they can find in other centers.
This employee of the public company admits that, beyond the technicians, there are some other profiles with greater responsibility that manage European projects of millions of euros that can collect up to 35,000 euros gross per year. “Now we also face many changes in the organization chart. There have been several arbitrary dismissals, eight as inadmissible, even one null, and the workers are afraid, ”he says.
JFM ensures that their salaries have not varied beyond what is stipulated in state general regulations. On the other hand, it focuses on the aspect of antiquity as a key element of the future agreement: “I do not know of any public company in which the age of its employees is not respected,” says.
The INCIBE confirms that their workers do not receive any plus for seniority. “The compensation of employees is divided into a fixed salary and a variable remuneration linked to the fulfillment of performance objectives,” the entity explained. Riesco emphasizes that “it is unassumable to keep workers in bad conditions while the general director charges 127.00 euros a year.” On the other hand, it also addresses the representatives of the Government: “We undoubtedly support the claims of this government on improving working conditions and uploading the SMI, but it is not understandable that they have forgotten the workforce of a company like this. It seems that if you are not in Madrid it is as if you did not exist. ”
Requirements for negotiation
A worker who also prefers to stay in anonymity for fear of work reprisals, with about nine years of experience in INCIB It happened. “He has put himself in profile despite being a socialist. The only thing he did was communicate to the direction of the Inbibe that we had sent him that letter and the Directorate criticized the Company Committee at a meeting with the employees, ”he states.
The Cybersecurity Institute indicates that it is “fully willing” to negotiate a collective agreement. Fear in the template
JFM reiterates that there is a lot of fear in the workforce when claiming job improvements. “In the last two years there have been arbitrary dismissals. The company also moves many positions and makes changes in the departments, which means that some professionals end up cornered as retaliation, ”he adds. Similarly, he complains about the constant work overload they suffer and that is never recognized by the company.
His partner subscribes these words: “There have been dismissals and people to whom their professional category has been degraded, sometimes replaced by others that do not have the most appropriate profile, so the staff is very afraid,” he defends.
At the moment, it will be the Regional Labor Relations Service in the first instance who attempts an approach between the business and the workforce. “At least for the company to comply with article 64 of the Workers’ Statute, because many times they do not even report the committee of changes in organizational measures,” explains the worker of the INCIBE. There is still no date for the act of avenencia.
