Proposal needs to be analyzed by two thematic committees and the plenary of the Chamber of Deputies
Bill 1,052 of 2024 makes it a crime, with a penalty of detention or seclusionthe so-called digital abandonment, that is, the fact that parents stop educating or providing assistance in the virtual environment, putting their children’s safety at risk.
The proposal provides for the initial sentence of detention, from 2 months to 1 year. If abandonment results in serious bodily injury, the penalty is imprisonment for 1 to 3 years. And, if it results in death, the penalty is imprisonment for 3 to 10 years. The proposal inserts the device into the Penal Code.
The author of the project, deputy Rogéria Santos (Republicanos-BA), highlights the harmful effects of abandonment in the virtual environment and its consequences resulting from parental negligence.
“Children and adolescents are vulnerable, and their fragility is also taken to the digital world. In view of the principle of Integral Protection, failure to comply with the duties inherent to family power leads to state intervention in order to protect the rights of children and adolescents”said the congresswoman.
Next steps
The project will be analyzed by the Social Security, Social Assistance, Childhood, Adolescence and Family committees; and Constitution and Justice and Citizenship. Then, it goes to the Plenary for analysis.
