Benefit worth 1 minimum wage is currently paid to dependents of INSS insured prisoners
The law project 6,024 of 2023under analysis in the Senate, determines that 30% of the value of the imprisonment benefit is directed to victims of crimes committed by the insured person who is arrested. The proposal suggests amending the Social Security Benefits Law (8,213 of 1991).
Current legislation establishes that imprisonment benefit is paid to the dependents of low-income workers while that insured person is detained in a closed regime and does not receive remuneration from the company for which he or she worked.
The benefit is also not paid if the insured prisoner is already receiving sickness benefit, death pension, maternity pay, retirement or service bonus.
According to the project, when there is more than one victim of the crime committed, the percentage of aid will be divided into equal parts between them. If the victim dies after the crime, the amount will be directed to his heirs.
In practice, the text determines the division of the prison allowance between the low-income prisoner's family and the victim of the crime committed or their heirs in the event of death due to the crime suffered.
Author of the proposal, Senator Plínio Valério (PSDB-AM) stated in the project justification that the change is a “measure of justice”. According to him, the crime committed “generates consequences for the legal sphere of the victim and their family members, who cannot remain outside social protection”.
The project is under analysis at CDH (Commission on Human Rights and Participatory Legislation). It will also be voted on CCJ (Constitution, Justice and Citizenship Commission) and in the CAE (Economic Affairs Committee).
The text has a terminative process, that is, if it is approved by the CAE, it will proceed to the analysis of the Chamber of Deputieswithout having to go to the Senate plenary – unless there is an appeal from the senators to do so.
