The parties of the investiture majority are gradually increasing the pressure on the Government to put preserve the associations of neo-nazi ideology. There have already been several times during this legislature in which these formations have registered initiatives in this sense in the Congress of Deputies. In this case, it is Republican Left of Catalonia (ERC) the party that puts pressure on the Executive. Public has had access to a series of written questions posed to him by Republicans to find out “what measures he is implementing to ensure that the legislation on associations does not end up allowing the dissemination of dangerous messages for coexistence and public safety”, as the document states.
ERC, in an official document signed by the deputy Francesc-Marc Alvarorefers to information about Public which explained that “The Ministry of the Interior accepted the registration of the neo-Nazi group Núcleo Nacional despite the fact that he had a police investigation underway.” Republicans do not understand why “a neo-Nazi entity with police investigation background” and a “possible connection with hate crimes and illicit activities” can obtain registration in the Interior without any problems.
It is something, they point out, that “generates worry” in relation to the “ability of the Government to stop and legally sanction groups that spread antidemocratic ideologies, such as Nazism or fascism“. Furthermore, they point out that “the Democratic Memory Law [aprobada recientemente] stipulates that State institutions have the obligation to combat and prevent the spread of ideologies that promote contempt or discrimination based on ethnicity, origin or other conditions“. However, they fasten, the Spanish Executive “affirmed that this same law does not include mechanisms for the illegalization of groups that spread hate messages.”
There exists, according to ERC, a “legal loophole“―a loophole― through which these types of associations “can evade institutional control.” On the other hand, they point out that the legislation of other European countries does tighten the siege on them. The organizations that the Republicans put as an example are National Nucleus and European Becoming.
The questions that ERC asks the Government and that will have to be answered in writing can be divided into three blocks: criteria that the State follows to allow the registration of associations and the mechanisms that exist to “prevent associations with potentially dangerous ideologies are registered as legal entities”; the comparison between the Spanish case and that of other countries, which, as Germanyhave legislation to prevent the proliferation of this type of groups; and, finally, the concern that arises that the Democratic Memory Law allow the development of “entities with links to Nazism or Francoism.”
They are also interested, more specifically, in the process through which the National Nucleus was included in the National Registry of Associations on August 8. “Has the Ministry of the Interior received, in the registration process of the National Nucleus association, any report or warning by the security forces and bodies about the activities of this entity or its members? If so, how does the Government justify that it proceeded with the registration despite the warnings?” asks Esquerra.
Sumar and Podemos, against Desokupa
Beyond this ETC movement, both Addas Can have presented initiatives to persecute another set of associations that deeply worries the leftist bloc: the companies of eviction. The purple ones, without going any further, proposed a law, as they did in the last legislature, to make them illegal.
From Sumar, there are already three sets of questions that have been registered to prohibit the activity of this type of company and, in particular, the best known: Desokupa. Those questions to the Government – still unanswered – They were recorded in August, September and October of this same year. In them, they describe “squad groups“to this type of associations and ask for their illegalization. We must not lose sight of the fact that, during the month of August, it was learned that Dani Esteve’s company had signed an agreement with the Unified Police Union (SUP) to carry out police training.
Offensive against the Francisco Franco Foundation
On the other hand, we must not forget that the Ministry of Culture, led by Ernest Urtasun (Movimiento Sumar), has begun the path to illegalize Francisco Franco Foundation. The Socialist Party, for its part, brought to Congress a reform of the Associations Law to advance the prohibition of any association that advocates the dictatorship. The Lower House admitted it for processing.
There is, therefore, growing parliamentary activity to focus on these types of associationsalthough parliamentary sources agree on the importance of having the necessary debates so that none of the possible laws or regulations that are approved are restrictive of freedom of expression.
