Genoa – Friday’s preliminary hearing for the collapse of the Morandi bridge and the death of 43 people could open with a twist. According to judicial sourcesin fact, the lawyers of six defendants (all managers, and technicians in the past in the cadres of Autostrade per l’Italia) will file a document in which they will ask for the recusal of judge Paola Faggioni called on Friday to decide on who to send to trial, who to acquit and who to accept the request for a possible shortened procedure of the sixty-one defendants (59 people plus two companies).
According to the defense lawyers dGiovanni Castellucci, former CEO of Aspi, Paolo Berti, former general manager, Michele Donferri Mitelli, former general manager of maintenance and the former managers and technicians Stefano Marigliani, Massimo Meliani and Paolo Strazzullo, the magistrate cannot judge as he has already ruled on some of the defendants and directly on the investigation of the Morandi bridge.
In particular, Faggioni has signed the order of custody with which in November 2020 the former leaders of Aspi were placed under house arrest for the scandal of dangerous sound-absorbing barriers. The request for recusal, therefore, if accepted, actually risks further lengthening the time of the trial because it will block the start of the preliminary hearing. In fact, the president of the Court of Appeal will be called to decide on the matter
