An unprecedented decision. Last Thursday, the Polish Constitutional Court has established that any sentence or regulatory act ofEuropean Union it must comply with Polish law, in order to be applied in Poland. The ruling means, in fact, that Poland it no longer recognizes the supremacy of European laws over Polish ones, and this goes against one of the founding principles of the European Union.
“I am deeply concerned about the sentence, I have hired the services of the Commission to analyze it thoroughly and quickly. On this basis we will decide the next steps “, said the president of the European Commission, Ursula von der Leyen. “THE European treaties“, he insisted,” are ‘very clear’: the rulings of the Justice Court of the EU are binding on the authorities of all Member states, including national courts, and EU law takes precedence over national law, including constitutional law, ”he added. “This is what all EU member states have signed as members of theEuropean Union. We will use all the powers we have under the treaties to guarantee it ”.
“The principle of the rule of law is that no one is above the law, so we are firm on this. The rule of law is also the limitation of powers, the underlying principle of Member states. Now, after the decision of the Polish Constitutional Court, I must say that if we do not confirm the principle inEU that equal rules are respected in the same way in every part of Europe, the whole Union will begin to collapse ”.
