the deputy Paulo Eduardo Martins (PL-PR) stated that the bill that punishes polling companies whose results are different from electronic voting machines should not be voted on before the 2nd round of elections, scheduled for October 30, 2022. This Tuesday (18. Oct.2022), the House approvedby 295 votes in favor and 120 against, the urgency of the proposal.
“Let’s try to build it, but it’s very difficult. The project is not for that election. It is more a situation of you being able to mobilize the House or not to vote. I personally would like to vote in this legislature because I will not be here next”, said Martins, who ran for the Senate for Paraná, but was not elected.
The deputy told the Power 360 who will be the rapporteur of the proposal being discussed in the Chamber.
To speed up the processing process, the project initially presented by the government leader, Ricardo Barros (PP-PR), was attached to a proposal that was already annexed to PL 96 of 2011 with the same theme and ready for a vote in the plenary.
During the session, Martins said that there are several initiatives with the theme in the House, but that the proposal under discussion “it will not necessarily be this text that is here linked to this urgent request”.
FINE AND JAIL
Barros’ proposal imposes fines and imprisonment from 4 to 10 years for companies that publish surveys whose results differ from the margin of error declared in the last 15 days before the elections.
The text intends to oblige media vehicles that want to publicize electoral research to also publish all electoral surveys registered in the Electoral Justice. The surveys in question must be from the same day or the day before. Failure to comply with this rule may result in a fine of 1,000 minimum wages.
To Power 360Martins said that this part of Barros’ proposal has support among congressmen.
“The idea is to make the search not used to change results. This is simple, because current legislation is already restrictive. You can’t post after Saturday at 10pm and now you just extend that deadline” he explained.
The deputy discarded the idea of imprisonment for those responsible for research companies in the text to be prepared by him. “No arrest, no criminal hypothesis”, he stated.
However, he said that the imposition of a fine for the dissemination of research with results different from the margin of error has the support of the deputies.
“The staff defends that there is a penalty of fine in case the institute errs beyond the margin of error. It has support, but I don’t like it. Personally I don’t like it, but I might have to build a text like this”, he says.
