The Proposed Amendment to the Constitution (PEC) of the Precatório was scheduled to be voted on this Wednesday (24) in the Senate’s Committee on Constitution and Justice (CCJ), but the government rush will give way to calm and negotiation. This is because the senators made an agreement before the start of the collegiate meeting and today the text will only be read.
Now, the idea is to start reading the report by senator Fernando Bezerra (MDB-PE), rapporteur of the PEC in the Senate and leader of the government, and vote on the text only next week. This CCJ vote must take place on Tuesday (30) or Wednesday (1) and, shortly thereafter, will be forwarded to the plenary.

Internally, the 27 senators of the CCJ do not want to speed up the vote on the text so much without first negotiating points that are still cloudy around the issue.
One of these topics of divergence around the text that was drafted in the Chamber of Deputies is the fiscal juggling that the Jair Bolsonaro government intends to do to break the Spending Ceiling and open a path to spend on the Budget. And to speed up the PEC in the Senate, the government is now working for a kind of slicing the text, in an attempt to approve parallel projects to support spending on social investments that impact the electoral campaign.
With the PEC, the government will have more than R$91.6 billion free in next year’s budget, and Jair Bolsonaro has already said that he will use the money not only to make the R$400 installments of Brazilian Aid for families in extreme conditions viable. poverty, but also promised to increase the salary of civil servants in an election year.
Locks in PEC
To curb the government impetus, the senators want to create barriers to the fiscal space that will be opened up with the “default in the Precatório” (extension of payments of the Government’s judicial debts, limited to the spending ceiling). The first of the moves, already accepted by Bezerra, is to leave the value of Auxílio as a permanent policy – the government’s initial idea was to end Bolsa Família and create Auxílio Brasil only until the end of next year.
In addition, the senators want the government to allocate all this money from court orders to expenses that are linked to the correction of the minimum wage, such as salary bonuses, unemployment insurance and Social Security. The idea is also to separate resources for spending on health and education and include the payroll tax relief program.
Rapporteur’s amendments
Used as the main artifice to accelerate the vote on the PEC of Precatório in the Chamber of Deputies, the rapporteur’s amendments are advancing in the debate on the 2022 Budget. These amendments, despite being provided for in the legislation, are controversial because it is impossible to know who is allocating resources to states and municipalities. In other words, it is possible to know where the money was sent, but there is no way to discover the author of this amendment.
In the Chamber, the scheme was exposed precisely because the Bolsonaro government used the resource to push the approval of the text, releasing the money as the allies loyalized the “yes” in the vote on the subject. According to the newspaper Estado de SP, congressmen presented a record amount of amendments for 2022 and want R$ 112.4 billion in amendments to finance works and services in their electoral strongholds.
The amount is seven times higher than what was already reserved for next year’s budget piece, an increase of 139% compared to 2020. One year ago, the amount indicated was R$ 47 billion, with vetoes of Bolsonaro and other cuts that took place in the following months, the total approved was around R$ 35 billion.
Part of all this money, argue the congressmen in favor of the device, will be removed from the fiscal space opened with the PEC dos Precatório.
