The joy of Enpa and Oipa: we have always and only asked for justice for this young bear and finally we turn the page
“Life imprisonment for large carnivores is the wrong way, while the only way to go is that of living together.” This is what the National Animal Protection Body (Enpa) and the International Animal Protection Organization (Oipa) write in a joint note, taking up the meaning of the decision taken by the Council of State regarding the capture of the bear M57, the bear plantigrade accused of having attacked a carabiniere in Andalo, a very small town in the province of Trento.
The Council of State yesterday agreed with the bear M57 and the two animal welfare associations on the appeal against the decision of the Trento TAR to legitimize the choice of the Province not to release the bearded bear currently imprisoned at Casteller after the attack last year. The Province will therefore have to give a new assessment of the danger to humans of the bear in question and eventually arrange for its release, albeit counterbalanced by the application of a radio collar to the animal, a technique already adopted for other specimens.
In the published text the Council of State affirmed that “the Province of Trento, having previously consulted Ispra, in the execution of this sentence will therefore have to assess whether the current conditions of the M57 model have exacerbated its aggressiveness to the point of suggesting the adoption of measures other than its release . In particular, with a view to the protection of public safety inspired by the principle of proportionality and the protection of the conditions of the animal as guaranteed by primary sources (also of community rank), the administration, with the aforementioned preliminary support, during the execution of this sentence will have to assess whether – having regard to the ascertained conditions, and where the real level of danger of the specimen exists – release with a radio collar is feasible, i.e. the solution similar to that previously adopted for the DJ3 specimen (of to which the appealed Province itself reports on page 12 of the reply, declaring that it does not oppose it) ».
In essence, the Council of State does not impose the immediate release of the bear, however it obliges the Province to consider the hypothesis of release after applying the radio collar, if the behavior of the animal allows it.
«A historic sentence – affirm Enpa and Oipa – of the highest profile that recognizes the validity of our positions, which finally enters into the merits, by thoroughly investigating an event so far dealt with in a hasty and superficial way. We will do our part, carefully following the concrete response of the Autonomous Province of Trento ».
