Open Foundation, the Supreme Court cancels the seizure in Carrai
The Supreme Court annulled the third and final order of the Florence review court and the search and seizure decree issued in 2019 by the prosecutor against Marco Carrai as part of the investigation into the Open Foundation. “The Supreme Court has also ordered – explains the lawyer Massimo Di Noia, defender of Carrai – with immediate effect to the prosecutor of Florence to return to Carrai what had been seized at the time, forbidding it to keep a copy of the data”.
“Over the years, the Court of Review of Florence – explains the defender – had already ruled on the same decree two more times and on both occasions its orders had always been canceled by the Supreme Court; the third order also had the same fate as the previous two, but this time the cancellation was without postponement, becoming definitive “.
“With this sentence, the Supreme College has closed, once and for all, the question and ruled – highlights the criminal lawyer – that there is not even the abstract hypothesis of the crime of illegal financing. party and that the Open Foundation has always operated lawfully to achieve its statutory purposes. The procedural choice of the Florence Public Prosecutor’s Office remains frankly incomprehensible: only after the hearing for discussion had been held before the Cassation and after the latter had postponed it for the sole purpose of making its decision known, did the Prosecutor request the referral to judgment of the accused, without waiting to know the decision of the Court “.
“Now, however, everyone, both at the Prosecutor’s Office and the judge of the preliminary hearing, will have to take note of the decisive and definitive response of the Supreme Court and draw the necessary consequences“, concludes the lawyer Dinoia.
Marco Carrai is one of the 15 suspects (4 are companies) for which the Florence public prosecutor has asked for indictment as part of the investigation into the Open Foundation on alleged irregularities in funding. The defendants with the Florentine businessman include, among others, Senator Matteo Renzi, former premier and leader of Italia Viva, deputy Maria Elena Boschi, group leader Iv in the Chamber, deputy of the Pd Luca Lotti and lawyer Alberto Bianchi, members of the so-called ‘magic lily’. The hearing to decide on the request to go to trial will be held on April 4 before the judge of the Court of Florence, Sara Farini. L‘investigation by the prosecutor, led by Giuseppe Creazzo, has been conducted since 2019 by the deputy prosecutor Luca Turco and the prosecutor Antonino Nastasi. Renzi is charged with the crime of illegal party financing together with the lawyer Alberto Bianchi, former president of the Open Foundation, in Carrai, Boschi, Lotti and the entrepreneur Patrizio Donnini. The Open Foundation was active between 2012 and 2018 to financially support Renzi’s rise and political activity, first as mayor of Florence and then as secretary of the Democratic Party, organizing among other things the Leopolda conventions.
