The defendant appealed to the Hearing claiming that the woman denounced him out of spite, but the court discarded his version
A neighbor of Cieza has been sentenced to nine months and one day in prison for threatening to kill his ex-partner. The defendant appealed the sentence before the Provincial Court alleging that these threats had not occurred and that his former partner had denounced him out of spite when trying, without success, to resume the relationship with him. The court, however, rejects his version and imposes on him, in addition to the jail sentence, a restraining order from the victim for one year and nine months and the prohibition of carrying arms for two years.
The events for which this young man has been sentenced occurred on March 15 at his home. According to the resolution, a discussion between the two began in the course of which the young man took the girl’s mobile that she was carrying and threw it against the wall. Then, he underlines the sentence, with the intention of intimidating her, he told her that he was going to kill her, at the same time that he pounced on her with the intention of attacking him but without success.
The court emphasizes, in its resolution, that the defendant has already been convicted on two other occasions for minor crimes of threats in the family sphere, for which an aggravating circumstance of recidivism is applied. In the sentence, however, the young man is acquitted of the minor offense of injuries of which he was initially accused.
