NATO | According to Minister of Justice Henriksson, the legislation is not changing under pressure from Turkey: “Finnish Kurds can continue to rely on Finland’s way of handling extradition requests”

The grounds for extradition requests made by a foreign state will always be evaluated accurately, impartially and legally, says Minister of Justice Anna-Maja Henriksson.

According to him, Finland is not changing its legislation to respond to the Turkish president Recep Tayyip Erdoğan to the demands made.

Part of the Kurds of Finland has been concerned that Finland bends to Erdoğan’s demands and, for example, the monitoring of them or the provision of information about them to the Turkish authorities increases. The extradition issues have also been on the back burner.

“I want to say to the Kurds of Finland that they can continue to rely on Finland’s way of handling extradition requests,” Henriksson tells HS.

According to him, signed in Madrid memorandum of understanding relies on the fact that in the future the states will also proceed in accordance with the Council of Europe’s extradition treaty. This is what the department head of the Ministry of Justice also said on Friday Antti Leinonen.

Henriksson’s according to the perception, Finland has not discussed any kind of lists of names of persons to be extradited with Turkey, and according to him, such is not Finland’s “way of doing things” at all.

According to him, neither the Ministry of Justice nor the Ministry of Foreign Affairs has yet received a single new extradition request.

In Finland, we will continue to act in such a way that when a request for extradition comes from a foreign country concerning a person, it will be reviewed very carefully by the Ministry of Justice and evaluated legally, says Henriksson.

According to him, this assessment does not include a political assessment, but officials justify their decisions in accordance with legislation and international agreements.

“I have served as the Minister of Justice for a total of more than seven years, and during this time I have never once hesitated that the authority dealing with extradition requests would act impartially and legally correctly,” says Henriksson.

“The rule of law and the equal treatment of every person are generally the most important issues for me as Minister of Justice. Our value base is based on these principles, and we will not compromise on them.”

To NATO aspiring Finland and Sweden signed a memorandum of understanding on Tuesday, in which the countries undertake, among other things, to deal “quickly and thoroughly” with unresolved deportation and extradition requests made by Turkey. In addition, the countries undertake to take into account the “information, evidence and intelligence” provided by Turkey.

Henriksson reminds that it is an agreement between three countries and some of the items or demands put forward by Turkey may be aimed “a little more” at Sweden than at Finland.

“It is worth remembering that we are talking about three different states here. On the other hand, Turkey and Sweden, like Finland, are committed to the extradition treaty of the Council of Europe.”

Between the member states of the Council of Europe, extradition due to a crime is observed convention, which does not include, for example, war crimes or crimes considered political. Countries also have the right to refuse to extradite their own citizens.
