A new drug propaganda case against rapper Morgenstern (real name Alisher Valeev) was closed for lack of corpus delicti. On Monday, July 12, the artist’s lawyer Sergei Zhorin told about this.
According to him, this time the administrative investigation was held in strict accordance with the law.
“As part of the initiated case, the relevant expert examinations were carried out, the necessary materials were studied and explanations were obtained. After all these actions, it was decided to terminate the administrative offense case due to the lack of corpus delicti in the actions of Morgenstern Alisher, “the lawyer said in an interview with REN TV.
This time, Morgenstern’s compositions Smoke, Freestyle Red Wine, and Whiskey for Breakfast were tested.
On June 3, the court fined Morgenstern 100 thousand rubles for promoting narcotic substances in the lyrics of his songs and videos “Rosé Wine – 2” and Family. Linguistic expertise showed that Morgenstern’s clips contain words and expressions that indicate the methods of making and using drugs. In addition, in the musician’s videos, according to experts, the image of an idol-addict as a socially successful person is created.
During the meeting, the defense asked the court not to use the last resort, provided for by the Code of Administrative Offenses, in the form of suspending the activities of the executor. In turn, the artist said that he would not “insist on justice.”
However, on June 14, the rap artist’s lawyer Sergei Zhorin noted that Morgenstern had appealed the court’s decision. According to Zhorin, the appeal is not connected with the amount of the fine, but with the fact that “there was no legal proceedings as such.”
In turn, the Moscow City Court upheld the fine and recognized the decision of the Zyuzinsky District Court as legal.
