Minister Alexandre de Moraes, of the Federal Supreme Court, ordered the Judiciary Secretariat to certify whether . The order was signed this Friday, 4th, shortly after the social network presented proof of transfer of the amounts to the STF.
The platform requested, for the second time, the unblocking of the platform in the country. Last week, Moraes denied the first request to reestablish the social network as he understood that there were still amounts pending payment. At the time, the minister made the return of the platform conditional on payment of all fines due.
There are three fines imposed on Elon Musk’s company: R$18.3 million for non-compliance with court decisions; R$ 10 million for alleged ‘fraud’ regarding the suspension of the platform; and R$ 300 thousand owed by the legal representative of X in the country.
X’s retreat occurred after an update to the platform allowed some Brazilians access to the social network. Moraes saw a ‘scam’ in blocking the platform in Brazil and imposed a fine of R$5 million per day on the company. On the other hand, X claimed that the attacks were the result of a ‘technical failure’, ‘unexpected and unintentional’.
While defending itself against the imputation of ‘fraud’ to the judicial decision, alleged threats and coercion against delegates working in the investigation into digital militias and the attempted coup d’état.
Before that, Moraes ordered the transfer, to the Union’s coffers, of R$18.35 million blocked from X and the satellite internet company Starlink due to fines for non-compliance with court decisions by the social network. As the amount was sufficient to cover the sanctions, the minister ordered the unblocking of the accounts and assets of billionaire Elon Musk’s companies.
