BRASÍLIA (Reuters) – Minister Alexandre de Moraes, of the Superior Electoral Court (TSE), gave President Jair Bolsonaro two days to speak out about a representation moved by opposition parties that are trying to prevent the Chief Executive from promotes hate speech and incitement to violence against opponents, under penalty of being fined.
In the request to the TSE, the parties cited a series of episodes that they consider that Bolsonaro had promoted violence, mentioning the recent case of the murder in Foz do Iguaçu of the PT municipal guard Marcelo Arruda by the Bolsonarista Jorge Guaranho during his birthday party, which had as its theme the PT and former president Luiz Inácio Lula da Silva.
In this case, the president did not make a vehement condemnation of the episode and even went so far as to indicate that the author had been provoked by a PT member.
The subtitles asked for an injunction to order Bolsonaro to refrain from making any kind of hate speech and incitement to violence, under penalty of being fined 100,000 reais per act and to order the president to condemn in a “clear and unequivocal” way on social media. social media and communication channels all types of discrimination and political violence, starting with the murder of Arruda, under penalty of an individual daily fine of R$ 1 million reais.
In his dispatch, Moraes said that a detailed examination of the context of the requests is necessary and that is why he asked for the president’s manifestation before taking a decision.
“In view of the foregoing, I order the subpoena of the represented party to present its manifestation within the legal period of 2 days. (…) After the expiration of the term, with or without a response from the represented, the Electoral Public Prosecutor’s Office is summoned for a manifestation within the same period of 2 (two) days, with a subsequent and immediate new conclusion to the Presidency, due to the recess”, stated.
Sought, the Attorney General’s Office said that it does not comment on the decision of the Judiciary.
