The Ministry of Labor dealt a heavy blow to the aspirations of the Colombian Association of Professional Soccer Players (Acolfutpro) to negotiate a collective statement with the Colombian Football Federation (FCF) and Dimayor.
Mintrabajo issued a resolution on Monday in which it decided to file the Acolfutpro complaint, filed on October 10, 2019, in which he argued that both the FCF and the Dimayor had refused to negotiate. However, he granted the association the resources for reconsideration and appeal.
Acolfutpro says that there are no guarantees with this government
In this regard, Carlos González Puche, executive director of Acolfutpro, told EL TIEMPO: “We have not been notified of the resolution, which is not final, and when we do, we will present the reconsideration and appeal resources for the new government to resolve, because it is evident that with this one we have no guarantees.”
It should be remembered that González Puche was in a shortlist as a possible sports minister, along with the Olympic medalist María Isabel Urrutia and Javier Suárez, former director of the IDRD.
Acolfutpro presented in September 2019 a list of demands to the FCF and Dimayor to regulate the activity of football.
Among the requests were the regulation of the calendar and rest periods, in which they requested that the tournaments not end after December 10; agree on the Player’s Statute, the Disciplinary Code and the single minute of the employment contract, and the realization of a Women’s League with a duration that would give the soccer players job stability.
In addition, they requested complementary health policies, to respect the 72 hours of rest, not to schedule games in cities with high temperatures before 5 pm
Other requests were the participation in television rights, an annual match of the Colombian National Team in favor of Acolfutpro, two annual meetings with the members of the men’s and women’s teams in their place of concentration, the arrangement of a number of tickets for the matches of the local tournament and the national teams and a protocol against discrimination, workplace harassment and gender violence.
The statement was rejected by the two entities, arguing that neither of them acts as the employer of the players.
Nevertheless, Acolfutpro replied by saying that, although they are not the ones who draw up the contracts, they do regulate the activity in the sense of designing the championshipsthe programming of vacation dates and competition calendars.
The reasons of Mintrabajo to reject the complaint
Initially, Mintrabajo had accepted the complaint and in February of this year announced that the investigation was still firm, at which time the Federation and Dimayor filed the appeal. Now, the decision favors the entities that manage Colombian soccer.
In the resolution, the Ministry highlights two things: one, that Acolfutpro does not have union registration, and two, that the FCF and the Dimayor are not the employers of the soccer players, therefore, the conditions to start a direct negotiation are not met and that these requests must be submitted to each club.
