Action says there was abuse of political power and asks for the removal of video from the president’s profiles on social networks
The presidential candidate coalition Luiz Inacio Lula da Silva (EN) triggered the TSE (Superior Electoral Court) asking the president Jair Bolsonaro (PL) is prohibited from using, in campaign, images of the speech at the 77th UN General Assembly (United Nations).
The action was filed on Tuesday (20.Sep.2022). Calls for an investigation into the alleged abuse of political and economic power and misuse of the media by the Chief Executive and his deputy candidate, Walter Braga Netto.
Lula’s coalition also asks Bolsonaro to remove the video of his participation in the assembly from his social media profiles. It also requested that the Court order the exclusion of the video from TV Brasil’s YouTube channel, “for serving as electoral propaganda for the candidate for reelection, seriously injuring the parity of arms of the election”.

The lawsuit filed is an AIJE (Electoral Judicial Investigation Action). It can lead to cancellation of mandate and ineligibility. Cases like this, however, have a long process in the TSE.
According to the coalition, Bolsonaro’s speech at the UN had a “electoral tone and away from the diplomatic posture of a Head of State”.
“Mr Jair Messias Bolsonaro maintains the deliberate attitude of confusing the figures of President of the Republic and candidate for re-election to the position”, says the lawsuit, signed by the lawyers of the Aragão and Ferraro and Zanin Martins offices. “This means, in practice, that Jair Bolsonaro used the prerogatives of his position to campaign for elections, breaking with isonomy in the electoral dispute.”
According to the lawyers, the tone of the speech showed the intention of the Chief Executive of “if used” from the occasion to “take stock of your government, compare it with the governments of your opponent in the election and 2022 and present proposals for the upcoming election”.
“In this way, it is clear that the use of images of the speech object of this AIJE in the social networks of the candidate Jair Bolsonaro perpetuates the rupture of the isonomy of the current electoral process, because it gives continuity to the abuse perpetrated, raising it to the exponential dissemination characteristic of virtual networks. ”.
Ciro Gomes’ (PDT) campaign for the presidency also filed a similar action with the TSE asking for a ban on the use of images of the speech at the UN by the Bolsonaro campaign.
