D.he Lower Saxony Higher Administrative Court in Lüneburg has suspended the exclusion of unvaccinated persons from body-related services under the current 2G and 2Gplus regulations with immediate effect. Even unvaccinated people should not be completely closed to services such as a hairdresser or foot care that satisfy “basic body care needs”, the court said on Friday. The judges described this regulation of the current Corona regulation in the country as “inappropriate”, because in view of the current number of infections it is “not a necessary protective measure”.
The current 7-day incidence in Lower Saxony is currently around 200, which is lower than in other countries. The risk of a corona infection is also “regularly limited to a few people present at the same time” at the hairdresser and similar services, argues the court. In addition, the risk can be significantly reduced by wearing an FFP2 mask and a previous test. The previous corona regulation in Lower Saxony only provides for an exception for those who are not vaccinated for those services close to the body that are “medically necessary”.
Incidentally, course approved by the state government
In the past, the Higher Administrative Court in Lüneburg has repeatedly rejected measures to combat pandemics as excessive. On Friday, however, the Lüneburg judges confirmed the current course of the red-black state government in Hanover in other proceedings. The judges consider the application of the 2-G-plus rules for sports facilities, theaters and cinemas to be lawful, because visiting such facilities is “regularly associated with a significantly increased risk of infection” that “is actually realized with the unvaccinated”.
The state government of Lower Saxony tried in the past few weeks to limit the number of infections with a strict 2-G plus strategy. The state government is increasingly moving away from this strict line due to a lack of tests and protests from the economy. Prime Minister Stephan Weil (SPD) would like to stick to the planned “Christmas rest” in Lower Saxony despite the rejection in the Prime Minister’s Conference on Thursday. “It is advisable to raise a dam if the flood has not yet come,” Weil said on Friday to the Evangelical Church Radio with a view to the Omikron variant. From Christmas Eve to January 2nd, stricter measures will apply in Lower Saxony.
Compulsory attendance at schools lifted
Education Minister Grant Hendrik Tonne (SPD) announced on Friday that the compulsory attendance at schools in Lower Saxony will be lifted from December 20, three days before the start of the holiday. At the request of their parents, students can then be exempted from teaching. There is no entitlement to distance learning on these days. The holidays should start on December 23rd as planned and last until January 7th. Tonne explained that parents who have not yet been fully vaccinated or boosted family members and relatives from high-risk groups need further protection for Christmas will be given the option of exempting lessons.
It was also announced on Friday that an Omicron infection was detected for the first time in Lower Saxony in a person who could not have been infected abroad. The affected district of Rotenburg (Wümme) said the exact origin of the infection was unclear. The Omikron case was discovered because the county was conducting a random inspection.
