Nintendo and The Pokémon Company are suing PocketPair, creators of Palworldfor patent infringement. It is not something totally unexpected, but it comes several months after the release of the video game. It is a particular situation and not so obvious.
A lawyer – Richard Hoeg – had his say online and so did a well-known Japanese analystSerkan Toto. Let’s see their comments.
Lawyer and analyst’s opinion on Palworld
First of all, attorney Hoeg explains that – although much information is still missing – it can be noted that Nintendo he is not suing for copyright infringement, but for patent infringement. This is a crucial distinction because copyright protects art while patents protect inventions.
In other words, Nintendo’s lawsuit It wouldn’t be aimed at things like Pal design (Palworld creatures) but to some game system. The lawyer at first glance can’t say exactly what these patents might be and PocketPair itself says it doesn’t have the details.
Beyond the more technical details, the lawsuit was obviously not launched by chance and analyst Serkan Toto explained that “Nintendo is notoriously protective of its intellectual property and has a very, very strong and feared legal team in the Japanese video game industry. Nobody wants to piss off Nintendo.”
According to Toto, “Nintendo wanted to be absolutely thorough. They didn’t want to just shoot randomly. They wanted to be absolutely sure that they had everything under control, that they had counterarguments against everything that Pocketpair is going to say in court, and only if they can build a really strong case that they think they can win, they will file the lawsuit. And I think Nintendo is taking this case thinking they’re going to win.. And I fear that, given the precedents, it is very likely that he will win.”
Toto says that he “can’t recall a single lawsuit Nintendo has filed in Japan that they lost. I think they’ve won them all.” While there’s a first time for everything, Toto also thinks that “this story will end badly for Pocketpair” and that Nintendo will try to get as much money as possible from the company.
