Laura Borràs asks the Supreme Court for amnesty for her conviction for splitting contracts by linking her to the process

The former president of the Parliament Laura Borràs has asked the Supreme Court for amnesty for her conviction for having split contracts to benefit a friend during her time at the head of the Institució de les Lletres Catalanes (ILC). Borràs makes the request to be amnestied before the Supreme Court, the instance before which she has appealed the ruling of the Superior Court of Justice of Catalonia (TSJC) that sentenced her to four and a half years in prison for the crimes of prevarication and document falsification.

The sentence itself (with a dissenting vote from a judge in favor of a sentence only for prevarication) proposed pardoning Borràs, considering that his entry into prison was disproportionate and excessive to his punished behavior, since the computer works improperly conveyed to contracts fractional ones were carried out. Furthermore, Borràs did not take a single euro into his pocket.

According to the ruling of the Superior Court of Justice of Catalonia (TSJC), Borràs “fictitiously divided” 18 contracts for computer work at the ILC between 2013 and 2017 and awarded them to a friend “with full awareness of disregarding and disregarding the most “elementary requirements of administrative contracting”. The court concluded that the leader of Junts agreed with her friend Isaías H. to hand over ILC contracts that should have been carried out through a public tender. Both agreed to prepare three false invoices to mask that there were three offers when in reality it was already decided that Borràs would commission the work to Isaías H.

However, as Isaías H. ended up actually creating the websites for the ILC and Borràs did not put a euro in his pocket, the court chose to ask the Government for a partial pardon so that the Junts leader does not have to go to prison.

By condemning her for prevarication and documentary falsification in public documents – the awards given to Isaías H. – and commercial documents – the false invoices sent to the ILC to simulate three offers –, the minimum sentence to be imposed on Borràs for this second crime was four years and a half in prison – the Prosecutor’s Office asked for six – but the court understood that it was a sentence “disproportionate and excessive for the reality that underlies the behavior” of Borràs.

The Chamber stressed that the corruption of Borràs and Isaías H. did not cause “economic damage” to the ILC and that both convicts did not seek to enrich themselves, but only to “mask” the “initial prevaricatory conduct” before the Intervention of the Generalitat with false invoices. that is, the decision to award contracts to computer scientists.
